It said the original award was $375 million compensatory. The victim was
83 years old. That's supposed to be based on projected earnings, right?

That jury must have been stoned out of its mind.

An 83 year old woman was expected to make $375 million before she died?
In what universe could that happen?

> That jury must have been stoned out of its mind.

$375 million is already ridiculous; bumping it up to $7.5 billion is
completely insane. In TV shows and movies, this kind of judgement
usually gets greatly reduced by a judge or appeal court. Surely that's
going to happen here, right?

Some of it is. Some of it is based on pain and suffering.

Yes, that will happen. Either the judgment will be reduced or they'll
come to a settlement with the victim or her estate. Nobody's getting
seven and a half gigabucks.

Hopefully part of the settlement will be a lot of people from spectrum
spending the rest of their lives in jail.

If it's compensatory rather than punitive then for sure that's
"impressive" for an 83 year old.

I can only hope to do so well...

The 375 million is 90% of the compensatory.
The 7 billion is the punitive.

Even $375m compensatory is impressive for a 83 year old (even most 20
year olds!)

I hope to live long enough to earn even 1/4 of $375M!

That would be completely noxious in legal terms since if the killer is
of sound mind he/she is totally culpable. If they're not then 0%
culpable.

Being of sound mind for legal purposes is never a 90-10 or 80-20 sort
of thing and offering that would total distort existing meanings of
culpability.

I would not be content with a system where every culpable homicide is
prosecuted as manslaughter. Particularly for mass killers like Willie
Pickton. (Killed 50+ women over 2-3 years, in the end for only tried
for 6 of them and received the kind of sentence which ensured he's
only leaving prison feet first - though I would prefer his burial site
would be inside the prison walls. Though I would not object to
cremation followed by firing from a cannon or being used for
fertilizer at the prison farm)

Here’s some more information about the crime and the forgery and the
verdicts although I still don’t know who’s responsible for the other 10%.
It sounds like their next fight is going to be with the IRS and/or FTC.

For criminal cases yes, that is the case. The fact that there are
monetary damage awards says this is a civil case where shared
culpability or liability are normal.

Reading that is appears that the jury is awarding damages based on the
company's general practice of covering up crimes by its employees rather
than just this one incident. The apparently blatantly forged documents
they introduced as evidence probably didn't help their case.

You have to love that they come up with a forged document with the wrong

While I now understand that this was a civil case, was it tried by
jury or by judge alone? (In Canada both are common in civil litigation
and only the largest cases go before a jury)

Several articles say Dallas Texas county jury.

I found articles that say a jury awarded the 7.5 billion, the 375 million,
and decided the 90% responsibility.

If it were about earnings alone, then it could be open season on the
retired elderly living on modest fixed incomes.

The punitive damages are no longer about the victim per se, but about
punishing the defense (as the word 'punitive' suggests) for egregious
behavior.

But setting the punitive damages high gives the plaitiffs something to
bargain with. The article also suggests that the plaintiffs' lawyer(s)
made a very good case for not just negligence on the part of the
defendant, but also for forgery on the part of the defendant's lawyers.
That's some deep doo-doo to wade into.

Which is why punitives should go to the state-- to be used to fund the
judiciary-- not the plaintiff.
