The Patent and Trademark Office refused a trademark for "Trump's Too
Small", a phrase to be sold on t-shirts. It's too suggestive.

The government in court says the phrase can be used but cannot be
trademarked without Trump's permission.

An appeals court sided with the applicant as refusing the trademark
violated speech rights.

Last I looked, a trademark protects the speech of the holder but not
everybody else.
