It's a legal technicality. In order to transfer the ownership of the house, Will would have to have Mildred declared dead. And if Mildred were declared dead, Will would lose her social security check. The ironic twist is that if Will doesn't come up with the back taxes he owes, he'll lose both the house and the social security checks.
