A speedy driver had to take evasive action to avoid a collision with a cyclist on a country road, Wick Sheriff Court heard on Wednesday.

It resulted in the driver, Ally Baikie, being charged with careless driving..

The 21-year-old pleaded guilty and was fined £300. He also incurred five penalty points.

The near-miss occurred on the single-track Sibmister Road, at Murkle, on July 30, last year.

Fiscal Emma Petersen said that the accused's car, a Ford Fiesta, was approaching the bend "at speed". Baikie swerved away and mounted the grass verge on the opposite side of the road, in order to pass the cyclist and avoid a collision.

The incident was recorded on another motorist's dash-cam. Solicitor Meegan Anderson said that Baikie, a fitter-welder, of Mackay Street, Castletown, "wouldn't be driving like that again".

She added: "The accused regrets having done so. He got a fright and has learned from it."

Motorists who are sleeping, or sitting in their vehicle have found themselves facing serious charges despite the fact that they have not actually driven or attempted to drive a vehicle.

I think you’ve got something there that shines a light on all those cyclist
Single Vehicle deaths: they fell asleep while on their bicycles! That might
account for the 50% of the ‘accidents’ to cycling MPs that occurred in the
last 11 years.

The offence you describe is being "in charge of a motor vehicle on a
road whilst having [blood alcohol in excess of a defined level]".

The Act specifically provides a defence to that charge, which is that no
offence is committed where the suspected person can show that there was
no prospect of his driving the vehicle in question at the time in
question. The provision does not mention keys.

The absence of the vehicle's keys makes driving the vehicle impossible,
though I dare say a seasoned fairy-cyclist has "ways" of bypassing the
steering lock and ignition system. But for normal people... not so much.

If you have to "swerve" and "mount a verge" to avoid a collision, you are GOING TOO FAST. You should never drive in a manner where you cannot stop within your visual limits.

Happened to me, only it was a tandem, so had quite a lot of killing power.
I shouted for them to get in the road, and got the usual “Fuck you!”
response so beloved of cyclists.

I expect more of the same in the coming 15-minute cities. Quite why mixing
vulnerable pedestrians and arrogant cyclists is seen as a good thing is a
mystery to behold.

Still it could be worse, we could be in Amsterdam.
