Yorkshire racism hearing: Vaughan lawyer calls ECB investigation 'wholly inadequate'
7 March 2023 • 5:46pm

A summary of the day's evidence
Andrew Gale accused of using the term "Rafa the Kaffir" on several occasions between 2008 and 2010. He is also accused of using the terms "P---" and, in reference to academy player Mosun Hussain, "s--- P---".
Malcahy KC cites ECB disciplinary proceedings against Gale in 2014 after he said during a match to Ashwell Prince, a black South Africa international, "f--- off to your own country".
In ECB's closing statement, Malcahy KC says historic tweets, for which Michael Vaughan has apologised, are "essential to this case".
Of Vaughan's historic tweets, Macahy KC said: "Instead, he asserts he would not have said those words. But the timing undermines him. The comment was made only a year or so before Michael Vaughan published tweets which he agreed were 'completely unacceptable'. Those tweets were ostensibly light-hearted but in reality offensive, as he also accepted. His comment to the players on June 22 2009 was in the same vein."
ECB closing statement concluded that "Vaughan's actions on day consistent with words alleged" in reference to 2009 Yorkshire huddle when "you lot" comment is alleged.
Stoner KC, speaking on behalf of Vaughan in his closing statement, says parts of the ECB investigation were an "affront to fairness" and "wholly inadequate".
Stoner KC showed panel a storyboard of grabs taken from the Sky footage showing Vaughan in the pre-match huddle at Trent Bridge. Footage shows Rafiq smiling and Vaughan staring towards the cameraman as the shot is turned in his direction. Stoner says the footage, also showing Rashid "in good spirits", is "entirely inconsistent with the evidence of Azeem Rafiq that the four Asian players 'all heard it' and the comment was said 'loud enough for all of us Asian players and the other Yorkshire players to hear it'".
Stoner KC concluded his case by saying the "shape" of Vaughan's "life and livelihood are at stake". "The process has not been fair," he said. "It was a wholly inadequate investigation."

4:49PM
Verdict could take three weeks or more
As the case concludes, Tim O'Gorman, chair of the CDC panel, suggests a verdict could take three weeks or more. "These are serious matters and we will deliberate very carefully," he said.

"These judgments will be given in writing and ideally we will attempt to produce them by the end of the month."

He pointed out the panel all have "other commitments" and full-time careers but "we will endeavour" to return their findings "promptly".

The panel then retired to consider its findings.
