A man in Tasmania has worked out that a council footpath is actually on
his property.

The council have told him that the footpath is part of a local highway
so that even though the land is owned by the man it doesn't stop the
council having the right to use it as a footpath.

Is the council correct?

Sounds like nonsense to me. The council can compulsorily acquire land
for use as a highway, but it has to pay the going rate for it. It cannot
just use a person's land that way.

property owner, hoping that he won't take it to court?
