If you order something from a retailer and they deliver it using Aus
Post, what happens if it gets delayed for several weeks in the mail?
Can you get a refund from the retailer?

You get to wait for it to turn up unless you paid for a quick delivery.

Not if it does turn up eventually.

There comes a point where the delivery is considered 'lost', and I
should be able to get a refund.

What am I supposed to do if I am relying on the delivery? Order again?

I was told by Aus Post it should be no more than 3 days if it's Sydney
to Sydney delivery. It's been 16 days.

How long am I expected to wait for the delivery?

The retailer needs to take liability for it, because I have paid them
for delivery and that hasn't been provided.

Ask Dechuka about bestiality if the doll bores you, he seems to be an
expert in that filed.

If a delivery date was specified as part of the contract you would have
to return the item when finally received and also claim a refund.

Good luck with that.

What you should have done is cancelled the order due to not receiving
on tile (if that was an essential part of the contract - probably
wasn't?) and demanded a refund.

If the supplies are so critical and they are delayed so long you won't

From memory, you would have needed to actually specify (or mutually
agree) on a delivery date, and including the words "time being the
essence of the contract".

You're wrong if it wasn’t sent insured.

The requirement is that the goods be delivered within a reasonable time.
In the context of a pandemic, what is a reasonable time would likely
depend on the impact the pandemic has on the ability of Australia Post
to deliver. So I think a delay due to the pandemic would not be
unreasonable, and an entitlement to a refund from the retailer would not
arise.

If the critical medical supplies are medications that you will continue
to need in future, your obvious course is to source further supplies
locally, and use the eventually delivered items later.

Otherwise you could negotiate with the retailer, and if you're lucky get
a refund subject to the return of the unopened package when it arrives,
or maybe get a credit against a future order.

Sylvia.

But methadone isn't a CRITICAL medical supply
and isn't posted out to recovering heroin addicts,
they have to drink it in front of the person
supplying it so they can't sell it to other addicts.

and wrong again RS. Take away methadone and buprenorphine may be dispensed.

However not sent through the mail, you'd be crazy to get critical
medical supplies sent through the post rather than use a courier.

It is the job of the vendor to deliver the product to me. If this fails
for some reason, then they must refund me.

The vendor has not completed the sale until I receive the goods.

Wrong, it is the responsibility of the seller to ensure delivery.

"Note: if the seller claims to have posted the product, they are
responsible for resolving any issues with Australia Post or the courier
company used to deliver the product."

Wrong. The sale is completed once you pay for the goods.

Getting a refund is dependent on other factors as well. Terms &
conditions of sale, for instance.
