It would hardly be very enigmatic if I were to explain, would it?

If somebody had already used a torrent client to obtain it, that
somebody could share them with somebody else. Although a torrent is
probably quicker, as there should be plenty of seeders.

Apropos of which, it's actually not illegal in Switzerland to download
stuff for personal use. Yes, personal pirating is allowed. Seeding it
is not, though, so I always remove everything from my torrent client
as soon as I've got the complete file.

Of course, with BitTorrent you are also potentially uploading chunks of
whatever you are downloading, even before you have completely finished
downloading it. Does the Swiss legislation explicitly prohibit *seeding*
or is (more likely) any uploading at all ?

As far as I'm aware my client (Vuze) doesn't start to seed until after
the download is complete, so it just needs a careful eye keeping on
it.

Also, it would be interesting to see whether any accusation of
wrongdoing actually records whether you uploaded anything, or just
assumes that you did since you were a member of the swarm.

If the prosecution alleges that you uploaded, based on your having been
a member of the swarm, could you realistically refute that ?

Yep the protocol is designed to favour sharing clients, hence the need to
confirm your client is reachable. Hit n run will get you banned from all private
trackers, most have minimum seeding times and/or percentages. Even on public
trackers I generally keep it going for a week or two or 110% whichever comes first

Never come across thism certainly haven't knowinglt suffered from slow
downloads, nor ever been banned, but then again I'm not using any
download service that requires a login of any sort, and my usage is
occasional just for the latest bestseller books and the odd music
back-catalog or (rare) new album I might have a fancy to.

I've never noticed stopping upload make any difference to
download speeds although I only do that one one site, still
have to meet minimum seed requirements on a few other
sites.
