There are two salient issues that pertain to the bench's decision.
Firstly Joko has to show that there was insufficient evidence for a case
to be brought against him. He doesn't need to show that the decision to
bring the case is flawed, only that it was unreasonable to do so. That
won't be easy for him, and it's why the govts case is based on only one
reason, ie. that it's against the public interest to allow him to stay.
If the govt had based their case on more reasons, his lawyers would have
more opportunity to mount a successful defence. Secondly, Joko has to
show that he's greatly disadvantaged by an unfavorable ruling, whilst
the govt is not, or at least not to the same extent. This is easy for
him to do, since he would not be able to play the AO. Therefore it seems
likely he will be granted an injunction. That's all he needs to be able
to stay and play. He doesn't need to actually win the case. (cue, Sylvia)
