Murder accused in court

WHITBY - A young man charged with murdering the son of a high-ranking Hells Angel appeared in court Thursday wearing a bulletproof vest.
Police officers led Carey Patrick Cleyndert, clean-shaven and sporting a buzz cut, into the Superior Court of Justice courtroom in leg shackles and handcuffs.

A pretrial conference had been scheduled earlier by the Crown and defence, but could not take place due to procedural problems.

Mr. Cleyndert, 19, of Scugog is charged with second-degree murder in the slaying of Jessie Owen Gray, 24, of Musselman Lake.

Mr. Gray was stabbed to death in Uxbridge on June 8, 2002 during a post-high school prom field party in north Durham attended by about 600 people.

At the end of a preliminary hearing last month in provincial court Mr. Cleyndert was committed to stand trial on the murder charge.

Since his arrest he has spent more than a year in custody in "super-segregation," for security reasons, and any delay in the case would be unfair, said lawyer Scott Cowan.

Mr. Cleyndert's conditions are extremely harsh given that he is confined to his cell 24 hours a day and is permitted just 20 minutes of outside time each week, said lawyer Riali Johannesson-Gruzuk, part of the defence team. "I would say super-segregation is soul-crushing," she said outside court.

Neither the defence, prosecutor Megan Allen or Mr. Justice Hugh McLean were blamed for the postponement of the pretrial, which was re-scheduled for July 29.

A trial isn't expected until early 2004.

DURHAM -- The Ontario Court of Appeal has denied a bid for a reduced sentence by a Blackstock man who was jailed 12 years for fatally stabbing a man during a brawl four years ago.
In a ruling released Tuesday the appeal court rejected Cary Patrick Cleyndert's argument his sentence for manslaughter was too steep and that a trial judge had erred in dismissing his claims of remorse. The court also ruled Superior Court Justice Robert Clark was correct in finding Jesse Gray, who was unarmed when he was stabbed eight times during a scuffle with Mr. Cleyndert, was a "vulnerable" victim.

"(Mr. Cleyndert) inflicted multiple stab wounds in a cluster on a vulnerable part of the victim's body (his torso)," Justices Eleanore Cronk, Susan Lang and Jean MacFarland wrote in their ruling. "Several of those wounds were life-threatening."

Mr. Cleyndert was 19 when he attended a post-prom party for students in rural Zephyr on June 8, 2002. During the party he became involved in a confrontation with Mr. Gray's girlfriend; when the 24-year-old Mr. Gray challenged him the two men fought. Mr. Cleyndert pulled a 5-inch butterfly knife -- a restricted weapon -- and struck the fatal blows.

Originally charged with second-degree murder, Mr. Cleyndert was found guilty of manslaughter after a trial in early 2004. During the trial Mr. Cleyndert's lawyer advanced a self-defence scenario, pointing out Mr. Gray's size and the fact he was punching Mr. Cleyndert when the stabbing occurred.

Justice Clark imposed a sentence of 12 years, deducting three and a half years of "dead time" Mr. Cleyndert spent in custody awaiting trial.

"(W)e see no basis to interfere with the trial judge's conclusion that the circumstances of this offence placed it at the high end of the appropriate range of sentence," the appeal court judges wrote.

Mr. Gray the dead was 5 years older than the convicted man and if he was anything like his 6 ft 5 inch 300 pound Dad in size.... but the man found guilty used an illegal weapon. 8 knife wounds can happen in less than 5 seconds.

A man booted from a bar in Brockville, Ontario reportedly broke free of his police escorts but landed in the wrong getaway car.

Cary Patrick Cleyndert, 29, allegedly jumped into a nearby vehicle and ordered the driver to “get out of here,” police told The Recorder & Times newspaper.

One hitch in the quick-thinking escape: he had picked an unmarked police cruiser.

Sgt. Surinder Gill told the paper the squad car was providing backup after police were called to the bar because Cleyndert had allegedly refused to leave.

Cleyndert was arrested for breaking the conditions of his parole by boozing, according to the Recorder & Times.

The only reason I am in this ng is because I posted about someone I knew who had his internment hours ago. My eye caught the C.W. McCall obit then of course this 2005 obit of Mr. Gray which for some reason Nelson Cross reposted today without comment. I have posted hundreds of times about H.A.M.C. don't think I ever mentioned Mr. Gray. Have posted in this ng before. This thread has over 1,800 Google groups views since 2005.
