his Twitter ban

The case is without merit. Twitter is not a government
institution (though you could argue "unofficial" these
days ... but you can't make it stick). The Fed - and by
extension state/city govt) can't shut you up but Twitter
damned well CAN - especially since it doesn't charge
for its "service".

Remember just a few years back when our reps (including
most Republicans) were SO keen on de-federalizing the
internet ? No more regs or mandates - profits profits
and more profits ! Yay !

Of course nobody, except for a lot of people, realized
that the net would almost instantly become a propaganda
conduit for the left-hand side of govt.

"Rights", as defined in the Constitution, mostly refer
to Citizen -vs- STATE ... not citizen-vs-citizen. Once
in the private sector, your "rights" diminish considerably.
It's been "traditional" to extend State rights down into
private-sector environments, but there's no REQUIREMENT
to do so. And now, as much as possible, they DON'T.
Sure, the INTENT is to help lefty pols/causes, but that's
their business.

SO ... this case is going to be thrown out entirely. However
they MAY drag it out just a bit, to deplete the wallets of
Mr. Berenson and supporters.
