If it is part of someone's job to scan very old paper records, if the
employee is a bit rough with the paper, and because the paper is very
old and fragile, it tears, can the employee say that they found the
paper that way and get away with it?

the paper tore, and therefore it's not your fault.

By inspecting the documents to see if care needs to be taken when
digitising them, stupid.
