Most employment contracts have a clause whereby both the employee and
employer can terminate the contract but must give 4 weeks notice.

What happens if an employee resigns but on the same day ceases to go
into work? Because they didn't give 4 weeks notice, do they now owe the
employer 4 weeks pay?

Not automatically. If the employer sustains an actual loss as a result
of the breach of contract, they could sue the employee. I doubt it
happens often, not least because it's arguable that the loss is that
incurred as a result of a reluctant employee not being present, which
could easily be zero, or even negative.

Sylvia.

Nothing special. They only get paid for the time they did work.

Nope, dope.

Couldn't the employer easily deduct the amount from any unsued leave
payout or other severance payout?

Then the employee would have to sue the employer which would be too
expensive to bother for most employees.

Why does an employee have to give 4 weeks notice then?

Anyone at any time can retain money they owe to other people if they
think they won't get sued.

Anyone deprived of owed wages etc. would probably just complain to the
Fair Work Ombudsman.

Sylvia.

Not legal to do that, even if the contract says that.

Wrong, as always. They don't have to sue. And the small claims system
isn't expensive and the employee doesn't have to use it anyway.

I'm not bluffed. If and when I am sacked, I intend to resign on the spot
and walk out of the office never to return.

Then the employer won't be able to do any hand-over or finalising of my
work, which will serve them right.

Not necessarily in my job. My employer would be majorly pissed off if I
just left suddenly.

There would need to be some handover of what I have been doing, because
without that it might take someone else a long time trying to work
things out.

I am not a dunny cleaner, but I don't know why you would denigrate that
job. It is an honest and legitimate job, and I wouldn't mind doing it
myself.

There might also be some handover in that job, because the cleaner might
know which chemicals and tools to use at particular sites, as well as
security cards and keys etc.

Trivial for your employer to give those to the new dunny cleaner.

It's just the same as any handover. The new or remaining employees
could work it out themselves but it would be easier if there was a handover.

That's why it's important that employers don't piss employees of when
they sack them. The employer benefits from an amicable handover.

That would be quite a hassle and cost for the employer if they had to do
that.

It would be a good way for the sacked employee to get back the employer
for sacking them.

Wrong, as always, given that anyone can clean a dunny,

Wrong, as always, given that anyone can clean a dunny
and the sacked employee isnt the only one that can spell
out the detail of where the dunnys are and how to get to
them,

Wrong, as always, and not even possible with a sacked bludger like you.

But still makes sense if they care about the security.

Which is why it makes sense to change the locks and codes, fuckwit.

And with well designed security, even if the sacked bludger
does keep everything, none of it will ever work there again.
