Surprise.

Yeah, right...

The jury knows the consequence. Looking at up to five years in jail,
Michael Sussman will start talking. The swamp won't allow it.

The swamp was a problem with the Mueller investigation. Apparently, when
questioned about why half of his team were radical Democrats, Mueller said
something like "That's what we had to choose from."

But of course John Durham knows that. He will keep putting the cards on
the table.

Yeah, you're weak that way. A jury needn't hear evidence on 'being a Democrat',
and will be instructed to pay attention only to the evidence and charges.

Jurors are unlikely to be familiar, for instance, with Washington Examiner
(a weekly that used to be a tabloid), but will know that Republican administrations
usually want to cut jobs in their town. Votes, not trial results, determine those jobs.

John Doe doesn't logically connect evidence to charges, and wouldn't be
a good juror. Selecting folk who ARE good jurors would be the normal
procedure.

Sussmann's defense is that he wasn't working on behalf of a client for
that particular meeting with the FBI? He was such a good Samaritan, he
delivered the information against the wishes of his boss?

That wouldn't work since one of John Durham team's court filings includes
Sussmann's congressional testimony in which Sussmann plainly admitted
going to the FBI on behalf of "my client".

FBI General Counsel] in September, and the general counsel of [Agency-2]
in December, you were doing that on your own volition, based on
information another client provided you. Is that correct?

Q: Okay. And your client also was witting/aware of you going to [redacted]
in February to disclose the information that individual had provided you?

A: Yes

Q: Okay. I want to ask you, so you mentioned that your client directed you
to have these engagements with the FBI and [redacted] and to disseminate
the information that client provided you. Is that correct?

A: Well, I apologize for the double negative. It isn't not correct, but
when you say my client directed me, we had a conversation, as lawyers do
with their clients, about client needs and objectives and the best course
to take for a client. And so it may have been a decision that we came to
together. I mean, I don't want to imply that I was sort of directed to do
something against my better judgment, or that we were in any sort of
conflict, but this was -- I think it's most accurate to say it was done on
behalf of my client.
