A smart lawyer could create an argument that if a judge states
something so factually incorrect after the trial that his bias could
trigger an investigation to bias during the trial.

"Former President Donald Trump took the stand in a New York courtroom
for roughly four minutes on Thursday to defend himself in the
defamation trial brought by the writer E. Jean Carroll, who alleges he
sexually assaulted her in a dressing room in the 1990s.

The former president, who denies Carroll's claims, was called to
testify by his own legal team. Judge Lewis Kaplan, who is overseeing
the trial and has already determined that Trump defamed Carroll,
severely restricted what he could tell the court.

Sitting stone-faced in the witness box, Trump testified that he stood
by his earlier deposition in the case, in which he denied having ever
met Carroll. He replied "no" when his attorney Alina Habba asked if he
had ever instructed anyone to hurt her."

Trump and his incompetent attorneys are trying to goad the judge into saying
things and taking actions that will give them an avenue for appeal. They remind
me of long-ago Manson family attorney Irving Kanarek. Kanarek apparently was a
really shitty trial attorney, but he was brilliant in appeals. Kanarek engaged
in outrageous courtroom antics in order to provoke judges into making mistakes
that would provide avenues for appeal. In Joseph Wambaugh's book "The Onion
Field," about the murder of an LAPD officer and the subsequent trial of the
killers, Wambaugh writes about an episode in which there was a complete lull in
the trial, during which the attorneys and the judge were quietly looking over
their papers. Kanarek suddenly blurted, "Objection, your honor." The judge and
the prosecutor looked up, befuddled, because nothing had been going on. The
judge asked Kanarek why he was objecting, and Kanarek replied, "The prosecutor
just said 'fuck you' to me." Bedlam broke out as the prosecutor shouted that he
had said no such thing and in fact had not been speaking at all. The prosecutor
was so enraged that he grabbed Kanarek by his shirt, prompting Kanarek to accuse
the prosecutor of assault. Kanarek eventually was removed from the case by the
judge. So was the prosecutor.
